Plaintiff, driving a car on a county road, stopped within two feet of an intersection of such road and a heavily traveled state highway. He testified that he looked to the right, saw no car approaching, proceeded into the intersection, and, after crossing the center thereof, was struck by a truck owned and operated by defendant coming from his right; that after starting into the intersection he did not again look either to the right or the left and did not know of the presence of the truck until his car was hit. His view to the right was unobstructed; the truck was in plain sight; there were no distracting circumstances. For the reasons stated in the opinion, it is held that plaintiffs contributory negligence was established as a matter of law, and defendant was properly granted judgment notwithstanding the verdict.
